The use of AI in warfare and surveillance is on par with the threat of biological weapons: the severity and scale of harm is so extreme that regulation won’t cut it—it requires a full-on ban.
Leaving life and death decisions to machines is dangerous and raises serious ethical concerns. These systems can malfunction, misidentify targets, or be manipulated. It undermines fundamental rights, amplifies biases and discrimination, concentrates power in unaccountable systems and increases the risk of accidental or unjust violence. We cannot allow the continued use of this technology at the cost of human dignity, democratic freedoms, and global peace. Congress must act now to stop the use of AI for surveillance in warfare.
This is why it's important to push back against surveillance and data collection whereer possible. The more data companies collect, the more data can be used against you if it gets in the wrong hands.

For a decade we have been warning legislators that facial recognition AI is a dangerous technology that is fundamentally incompatible with human rights. Whether facial recognition is directly in the hands of ICE, or being run on Flock cameras at a Lowes Home Improvement Center that feed to ICE, or being used by a local government office that (wittingly or not) shares data with ICE—the end result is the same: databases of everyone’s identity, movements, and affiliations that can span years. Facial recognition creates a broad, warrantless hoard of surveillance data that can instantly be weaponized for intimidation and oppression. It has no place in a free society and we will continue to fight to see it banned in every arena: ICE agents should be banned from using it; city and state governments including law enforcement should be banned from using it; and businesses should be banned from using it in all places of public accommodation. We cannot let this regime of data-supercharged fascist witness intimidation become the new normal. It is time to ban facial recognition for good and banning ICE from using it is a great start.”

Milquetoast calls for better identification, bodycams, and training fall far short of what is required of lawmakers to meet this moment. We need a moratorium that includes automated license plate readers, access to data broker databases, spyware, drones, facial recognition, phone snooping and surveillance, and social media and internet use trackers. Regardless of lawmakers' interest in accountability, community movements against ICE are only gaining momentum. There’s a groundswell of concern is growing among security-minded people about AI agents and even Signal and the ACLU have expressed concerns. This is gonna be a year of reckoning for invasive surveillance tech.
If last month’s news is any indicator, we’re betting we can expect a lot more grandstanding from Senators like Dick Durbin & Lindsay Graham concerning a Section 230 repeal in the interest of appearing tough on their Big Tech donors in 2026. So we created a bingo card for how this threat will play out in 2026. Some of what’s to come...
In the harsh grey light of January, we are laser-focused on looking forward. While prioritizing our work, learnings, and relationships, we figured we’d play some bingo. The 2026 Internet will certainly offer many bingo-worthy happenings, so here is one of three big categories we’re accounting for as we begin another year in the trenches for digital human rights and a better Internet.
It’s good that local officials in cities targeted by 🧊 are speaking out and condemning their brutal tactics. But talk is cheap! 🧊violence is enabled by surveillance, often with help from local police and city-run surveillance systems. If local leaders want to protect their residents from 🧊’s gestapo tactics, one of the most immediate things they can do is roll back and limit surveillance by cancelling contracts with surveillance vendors like Flock and banning the use of facial recognition and other forms of biometric surveillance either through executive action or city ordinance.
Loss of Community Spaces Platforms could ban discussions on sexual health, reproductive health + gender to avoid legal harassment. 🚫 Silencing Marginalized Voices Loss of online free speech rights of marginalized people + those seeking accurate, safe abortion and gender affirming care information. 🎯 Increased Harassment Risk Without Section 230’s moderation protections, sites may stop removing hate speech—leaving LGBTQ users and abortion seekers more exposed. 💼 Harm to Small Platforms Many small platforms won’t survive the legal risks —pushing people seeking abortion or gender affirming care out of safer, smaller spaces like BlueSky or Reddit into Big Tech
We’re making space to celebrate victories! Here a just a few: This year we continued to mobilize queer communities, parents and youth to hold lawmakers accountable for supporting censorship bills and other harmful legislation including online ID mandates and the Kids Online Safety Act (KOSA). We united a coalition of 30 leading rights organizations, including Amnesty International USA, the Center for Constitutional Rights, Access Now, the Electronic Frontier Foundation, and the Electronic Privacy Information Center (EPIC), to demand that administrators at 60 major U.S. universities end campus surveillance and dismantle invasive data collection systems. We also partnered with COVID Safe Campus to launch a campus mask policy scorecard. We built out a huge coalition of nearly a hundred groups calling on lawmakers to invest in child safety without sacrificing digital privacy, freedom of information, or the very usability of the Internet, and drove thousands of calls to their offices with webinars, Reddit AMA’s and Livestreamed committee hearings, growing a substantive and hopeful discourse around censorship and surveillance threats of Bad Internet Bills.
Democrats like to say that they are trying to sunset Section 230 as a way to rein in Big Tech, when really the loss of this law will give tech billionaires the right to silence us all. If they really wanted to rein in Big Tech, lawmakers would pass robust federal data privacy and antitrust legislation so that people would be protected online, and have real choices beyond the billionaires’ club.”
The state of the internet today is a big problem that requires big solutions. Repealing one law is not a solution. If anything, it’s a punch that will miss tech oligarchs and land on those who want to hold them to account. For far too long, politicians have pulled the more-censorship-and-surveillance lever at the urging of Big Tech lobbyists, as if greater policing would stop the gaping wound at the heart of our digital lives. Taking away even more human rights online—this time, the right to protest and critique—is not the solution. Instead, politicians should commit to the hard work of restoring human rights and dignity. Restoring our right to privacy, so that our digital documents and movements are as private and protected as physical ones, would go far to combat the toxic digital panopticon that forces us into manipulative online echo-chambers. Breaking up tech monopolies would allow small businesses to grow and find their niche serving the rainbow of the Internet. Incentivizing interoperability and robust, fine-tuned user controls would let everyday people decide what they let into their homes and their minds. And, most importantly, addressing the core social ills that prevent human thriving in every sphere, including healthcare, high quality education, living wages, and stable housing for all would alleviate so much of the suffering and toxic strife that mars our experience of each other and the world. In the face of this higher call, unraveling the Internet’s first amendment is not only wrongheaded, but a cop out at a moment when we need Democrats to finally step up.

LGBTQ+ people’s rights are being stripped globally in areas where online ID checks are being implemented. This is not fear-mongering- the name of the game is control. The goal is to censor us off the internet + trans people are the canaries in the coal mine.

We’re outside in New York and San Francisco telling companies like @reddit + @youtube that they can shove it with online ID checks! Beyond the concerns with having to share personal data with companies that have shown they are unable to secure it, age verification laws are inherently meant to block off parts of the internet to younger users, many of them being queer youth who rely on the internet for support. Keep the pressure on these platforms to take strong, human-rights-preserving stances!

Bills like KOSA have unnecessarily divided advocates for Big Tech accountability. While some of the changes to the House version of KOSA move the bill toward being a rights-affirming piece of legislation, one change we are worried about is its preemption of state laws. State preemption is becoming increasingly common across House bills like KOSA and COPPA 2.0. We are strongly against preemption when it comes to defending human rights, and have found broad agreement among civil society and parents groups here. Many states have done what Congress refuses to: pass meaningful laws that increase privacy and protect rights in the face of rapidly advancing surveillance technologies. These laws shield everyday people from the constant tracking of where we go, our routines, how we spend, who we associate with, and what we do with our time. Preemption undoes all that work. It lowers the ceiling for privacy and protections, rather than raising the floor. We remain against preemption in KOSA and COPPA 2.0, just like we are against preemption of state AI regulations. We think that when it comes to privacy and human rights, preemption in general takes away people’s protections under state laws and destroys the work of local advocates and local communities. Let the brightest minds and best advocates across the country lead the way toward a safer and more rights-affirming future.
